Terms and Conditions

These Terms of Service (“Terms”) govern your use of the Calmeter mobile application (the “App”) and the Calmeter website (the “Site”) operated by Calmeter LLC (“we”, “us”, or “our”).
By accessing or using the App or Site, you agree to be bound by these Terms. If you do not agree, please discontinue use immediately.
1. Use of the Service
Calmeter provides nutrition insights, tracking tools, and lifestyle features to support healthy habits. You agree to use the Service only for lawful purposes and in compliance with these Terms.
You agree not to:
Interfere with the operation or security of the App or Site
Attempt to access another User’s account or personal data
Upload harmful code, automated scripts, or disruptive content
Use the Service for commercial resale or data harvesting
2. Account Requirements
To access certain features, you may need to create an account. You agree to:
Provide accurate and current information
Maintain the confidentiality of your login credentials
Notify us of unauthorized account activity
You are responsible for all actions taken through your account.
3. Health & Wellness Disclaimer
Calmeter provides general wellness and nutrition information for educational purposes only.
Calmeter is not a medical organization and does not:
Provide medical or clinical advice
Diagnose, treat, or cure any disease
Replace professional healthcare guidance
Always consult a qualified health professional before making major diet or lifestyle changes. Use of the Service is at your own risk.
4. Purchases & Subscriptions
Some features may require a paid purchase or subscription.
By making a purchase, you acknowledge that:
Prices and availability are subject to change
We may refuse or cancel an order for reasons including errors, availability, or suspicion of misuse
Subscription billing terms will be clearly displayed at checkout
Payments are processed by secure third-party payment processors
5. User Content
You may upload or submit data such as meal logs, nutrition metrics, or personal notes. You retain ownership of your content.
By using the Service, you grant Calmeter a limited license to store, process, and use this data solely to operate and improve the App and Site.
6. Intellectual Property
All trademarks, logos, text, images, software, and other materials provided through the App and Site are the property of Calmeter LLC and protected under applicable intellectual property laws.
You may not reproduce, modify, distribute, or create derivative works from the Service without permission.
7. Prohibited Activities
You agree not to:
Reverse engineer or extract source code
Use automated tools to scrape or index the App or Site
Upload unlawful, abusive, or harmful content
Attempt to bypass payment systems or security features
8. Disclaimer
Your use of the App or Site is at your sole risk.
The Service is provided on an “AS IS” and “AS AVAILABLE” basis.
Calmeter LLC disclaims all warranties, express or implied, including but not limited to:
Merchantability
Fitness for a particular purpose
Non-infringement
Accuracy or reliability of results
We do not warrant that:
a) The Service will operate uninterrupted or securely
b) Any defects will be corrected
c) The Service will meet your expectations or requirements
9. Limitation of Liability
To the fullest extent permitted by law, Calmeter LLC and its directors, employees, partners, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
Loss of profits
Loss of data
Loss of goodwill
Business interruption
Inability to access or use the Service
Unauthorized access, alteration, or use of your content
This applies regardless of the legal theory (contract, tort, negligence, warranty, etc.), even if we have been advised of the possibility of such damages.
10. Termination
We may suspend or terminate your access to the App or Site immediately and without prior notice, for any reason, including but not limited to breach of these Terms.
Upon termination, your right to use the Service will cease immediately.
You may terminate your account at any time through the App’s account settings.
11. Age Requirements / COPPA Compliance
You must be 13 years of age or older to use the App or Site.
We do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal data, contact us immediately so we can remove the information.
12. Third-Party Services
The Service may integrate with analytics providers, payment processors, or other third-party tools. We are not responsible for their content, practices, or policies. Your use of third-party services is subject to their respective terms.
13. Changes to the Service
We reserve the right to modify, suspend, or discontinue any part of the App or Site at any time without liability.
14. Changes to These Terms
We may update these Terms periodically. When updated, the "Effective date" at the top of this page will be revised.
We may also provide notice within the App or Site before updated Terms become effective.
Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles.
Any dispute arising under these Terms shall be resolved in courts located in Tennessee, unless otherwise required by applicable law.
