Terms And Conditions
The rules and protections that govern your use of the Calmeter app and your relationship with Calmeter LLC.
Effective date: June 1, 2025
This Subscription Policy explains how Calmeter Plus subscriptions work, what you will be charged, how to manage or cancel your subscription, and how refunds are handled. All billing is processed by Apple through the App Store.
Calmeter Plus
Calmeter requires an active Calmeter Plus subscription or a free trial to access its features. Calmeter Plus is available on two plans:
Monthly — billed monthly
Yearly — billed annually
Current pricing for each plan is displayed in the App before purchase and may vary by region as determined by Apple.
Free Trial
The Yearly plan includes a 7-day free trial for new subscribers. During the trial you have full access to all Calmeter Plus features at no charge.
Your subscription begins immediately at the end of the trial period. Your Apple ID will be charged the Yearly plan price within 24 hours before the trial ends unless you cancel before that time. Any unused portion of your free trial is forfeited when a paid subscription begins.
To avoid being charged, you must cancel at least 24 hours before the end of your trial period. See the Cancellation section below for instructions.
The free trial is available once per Apple ID. Previous Calmeter Plus subscribers are not eligible for a new trial.
The Monthly plan does not include a free trial.
Billing and Auto-Renewal
Calmeter Plus is an auto-renewing subscription. By subscribing, you authorize Apple to charge your Apple ID at the price shown at the time of purchase, at the start of each billing period.
Your subscription automatically renews unless you cancel at least 24 hours before the end of the current billing period. Renewal charges are applied within 24 hours before the current period ends.
You can confirm your next billing date and renewal amount at any time by going to Settings → [Your Name] → Subscriptions → Calmeter on your iPhone.
Cancellation
You may cancel your subscription at any time. Canceling stops future charges but does not end access to Calmeter Plus for the remainder of your current paid period.
To cancel:
Open the Settings app on your iPhone
Tap [Your Name]
Tap Subscriptions
Tap Calmeter
Tap Cancel Subscription
You can also manage your subscription through the App Store app under Account → Subscriptions.
Cancellation takes effect at the end of your current billing period. After that date your account will enter read-only mode and new data cannot be logged until a subscription is reactivated. Your existing data and progress are retained.
Refunds
All payments are processed by Apple. Calmeter does not have access to your payment details and cannot issue refunds directly.
To request a refund, visit reportaproblem.apple.com and select your Calmeter purchase. Apple reviews refund requests on a case-by-case basis in accordance with their purchase terms.
Subscription fees are generally non-refundable for any unused portion of a billing period after cancellation.
Price Changes
We may update subscription pricing from time to time. If the price of your subscription increases, Apple will notify you before the change takes effect. You may cancel before the new price applies if you do not agree to it. Continued use of Calmeter Plus after the effective date of a price change constitutes your acceptance of the new price.
For significant price increases, Apple may require your explicit consent before renewing at the higher price.
Restoring a Subscription
If you have an active Calmeter Plus subscription and are not seeing premium features — for example after reinstalling the App or setting up a new device — tap Restore Purchases on the subscription screen. This restores your subscription at no additional charge.

These Terms and Conditions ("Terms") govern your use of the Calmeter mobile application (the "App") operated by Calmeter LLC ("we", "us", or "our"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
These Terms incorporate our Privacy Policy and Subscription Policy by reference.
Eligibility
You must be at least 18 years old to use the App. By using the App, you confirm that you are 18 or older. If we learn that a user is under 18, we will terminate their account.
Accounts
You must create an account to use Calmeter. You may register with an email address and password, or through Google Sign-In or Apple Sign-In. Use of Google Sign-In is subject to Google's Terms of Service. Use of Apple Sign-In is subject to Apple's Terms and Conditions.
You are responsible for keeping your login credentials secure and for all activity that occurs under your account. Notify us immediately at support@calmeter.com if you believe your account has been compromised.
You may delete your account at any time from within the App under Account → Account → Delete Account. Deletion is permanent. Your data will be removed from our systems within 30 days.
Subscriptions and Billing
Calmeter Plus is an auto-renewing subscription processed by Apple through the App Store. Pricing, billing terms, free trial eligibility, cancellation instructions, and refund information are described in full in our Subscription Policy.
All payments are charged to your Apple ID. Calmeter does not process payments directly and does not have access to your payment card details.
Not Medical Advice
Calmeter is a general wellness and nutrition tracking tool. It is not a medical device, healthcare service, or clinical application.
Nothing in the App constitutes medical advice, a diagnosis, a treatment recommendation, or a substitute for consultation with a qualified healthcare professional. Do not use Calmeter to make medical or clinical decisions. Always consult a licensed physician, registered dietitian, or other qualified healthcare provider before making changes to your diet or health routine, particularly if you have a medical condition.
Use of the App does not create a doctor-patient or dietitian-client relationship between you and Calmeter LLC.
AI Meal Analysis
The App's camera feature uses AI to estimate the caloric and nutritional content of photographed meals. These estimates are generated automatically and may not be accurate. Factors including lighting, portion size, ingredient variation, and food preparation method can affect results.
AI-generated nutrition estimates are provided for general informational purposes only. You should verify estimates against nutrition labels or other authoritative sources where accuracy matters. Do not rely on AI estimates for the management of a medical condition, eating disorder, or clinical dietary program.
Third-Party Services
FatSecret: Food search and barcode scanning in the App are powered by the FatSecret Platform API. By using these features, you agree to be bound by the FatSecret Platform API Terms of Use. Calmeter does not own or control the FatSecret food database.
Firebase (Google): The App uses Firebase for authentication, data storage, push notifications, and analytics. Use of these services is subject to Google's Terms of Service.
Apple App Store: The App is distributed through the Apple App Store. Apple is not a party to these Terms and bears no responsibility for the App or its content. Apple has no obligation to provide maintenance, technical support, or warranty coverage for the App. In the event of any claim by a third party that the App infringes their intellectual property rights, Apple is not responsible for the investigation, defense, settlement, or discharge of such claim.
Your Content
You retain ownership of the meal photos, food logs, weight entries, and other data you create in the App. By uploading content, you grant Calmeter LLC a non-exclusive, worldwide, royalty-free license to use and process your content solely to operate the App, deliver features, and improve AI analysis. We do not sell your content to third parties.
You are responsible for any content you submit. You agree not to upload content that is unlawful, obscene, or that infringes the rights of others.
Prohibited Uses
You may not:
Use the App for any unlawful purpose
Attempt to reverse engineer, decompile, or modify the App
Access or tamper with systems or data you are not authorized to access
Use automated tools to scrape, collect, or extract data from the App
Impersonate another person or misrepresent your identity
Use the App to harass, threaten, or harm others
Intellectual Property
The App, including its design, features, text, graphics, and underlying software, is owned by or licensed to Calmeter LLC and protected by applicable intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.
You may not copy, distribute, reproduce, or create derivative works from any part of the App without our written permission. All rights not expressly granted are reserved.
Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind. To the maximum extent permitted by law, Calmeter LLC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We make no warranty regarding the accuracy of AI-generated nutrition estimates or the completeness of the FatSecret food database.
Limitation of Liability
To the maximum extent permitted by applicable law, Calmeter LLC's total liability to you for any claim arising from these Terms or your use of the App shall not exceed the greater of the total fees you paid to Calmeter in the 12 months preceding the claim or $50.
Calmeter LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of revenue, or harm resulting from reliance on nutrition information or AI analysis, even if we have been advised of the possibility of such damages.
Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited by law.
Indemnification
You agree to indemnify and hold harmless Calmeter LLC and its officers, directors, employees, and agents from any claims, losses, damages, or expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your violation of any applicable law or third-party right.
Termination
We may suspend or terminate your account at any time if you violate these Terms or if we discontinue the App. You may stop using the App and delete your account at any time. Upon termination, your license to use the App ends. Sections that by their nature should survive termination — including disclaimers, limitation of liability, indemnification, and dispute resolution — remain in effect.
Dispute Resolution
You and Calmeter LLC agree to first attempt to resolve any dispute informally. If you have a dispute, contact us at legal@calmeter.com with a description of the issue and the resolution you are seeking. We will attempt to resolve the matter within 30 days.
If informal resolution fails, any dispute arising from these Terms or your use of the App shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. You waive the right to participate in a class action lawsuit or class-wide arbitration.
This arbitration clause does not apply to claims for injunctive or equitable relief related to intellectual property, or to claims that qualify for small claims court.
Governing Law
These Terms are governed by the laws of the State of Tennessee, without regard to its conflict of law principles. For any claims not subject to arbitration, you consent to the exclusive jurisdiction of the courts located in Tennessee.
Changes to These Terms
We may update these Terms from time to time. When we do, the effective date at the top of this page will be updated. We will notify you of material changes through the App or by email. Continued use of the App after changes take effect constitutes your acceptance of the revised Terms.

Calmeter LLC ("us", "we", or "our") operates the Calmeter mobile application (the "App"). This Privacy Policy explains what data we collect through the App, how we use it, who we share it with, and the rights you have over your information.

Information We Collect
Account Information
When you create an account, we collect your name and email address. If you sign in with Google or Apple, we receive your name and email address from those providers in accordance with their privacy policies.
Health and Body Metrics
To generate your personalized nutrition plan, we collect:
Age
Biological sex
Height
Weight
Activity level
Weight goal and target weight
This information is stored securely and used solely to calculate and personalize your daily nutrition targets.
Nutrition and Meal Data
As you use the App, we collect:
Meals you log, including food names, portion sizes, and nutritional values
Daily calorie and macro intake (carbohydrates, protein, fat, fibre, sugar, sodium)
Water intake
Weight entries over time
Meal Photos
When you use the camera feature to log a meal, your photo is uploaded to our secure cloud storage and processed by an AI image analysis service to identify food items and estimate nutritional content. Photos are associated with your account and retained as part of your meal history.
Device and Usage Data
We collect information about how you use the App, including features accessed, events performed, and general usage patterns. We also collect device information such as device model, operating system version, and crash reports to diagnose and fix technical issues.
Push Notification Token
If you enable push notifications, we store a device token provided by Apple to deliver notifications such as meal analysis results and personalized insights.
How We Use Your Information
We use the information we collect to:
Create and manage your account
Generate and personalize your nutrition plan
Analyze meal photos using AI to identify food and estimate macros
Deliver push notifications you have opted into
Provide personalized insights and progress tracking
Process your subscription through Apple
Diagnose crashes and technical errors to improve the App
Understand how the App is used in aggregate to guide product improvements
Third-Party Services
We use the following third-party services to operate the App. Each processes data on our behalf under confidentiality obligations.
Firebase (Google) — authentication, data storage, cloud functions, analytics, crash reporting, and push notification delivery. Privacy policy: https://policies.google.com/privacy

AI Image Analysis — when you photograph a meal, the image is transmitted to a third-party AI service for food recognition and nutritional estimation. We may use one or more leading AI providers for this purpose. Images are processed solely to return nutritional data and are not used to train external models or for any other purpose.
FatSecret — food database used when you search for food items or scan barcodes. Your search queries and barcode scans are sent to FatSecret's API to retrieve nutritional data. Privacy policy: https://www.fatsecret.com/privacy-policy
Apple App Store — all subscription payments are processed by Apple. We do not receive or store your payment card information. Apple's payment privacy policy applies: https://www.apple.com/legal/privacy
Payment Information
All purchases and subscriptions are processed by Apple through the App Store. Calmeter does not collect, store, or have access to your payment card details.
How We Protect Your Information
We implement appropriate technical and organizational measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction. Data is stored using Firebase's secure cloud infrastructure and transmitted over encrypted connections.
Data Retention
We retain your personal data for as long as your account is active. If you delete your account, your data is permanently removed from our systems within 30 days. Crash reports and aggregated analytics data may be retained in anonymized form after account deletion.
Your Rights
Depending on your location, you may have the following rights regarding your personal data:
Right to access — you may request a copy of the data we hold about you
Right to correction — you may update inaccurate data directly within the App under Account settings
Right to deletion — you may permanently delete your account and all associated data at any time from within the App under Account → Account → Delete Account
Right to data portability — you may request a copy of your data in a portable format by contacting us
Right to opt out of analytics — you may limit analytics data collection through your iOS device settings under Privacy & Security → Apple Advertising and by adjusting per-app permissions

Children's Privacy
The App is not intended for individuals under the age of 18. We do not knowingly collect personal information from anyone under 18. If you believe a minor has created an account, please contact us at privacy@calmeter.com and we will remove the information promptly.

We may update this Privacy Policy from time to time. When changes are made, the effective date at the top of this page will be updated. We encourage you to review this page periodically. Continued use of the App following any update constitutes your acknowledgement of the revised policy.
